Summary:

The Department of Environmental Quality has published a draft rule to revise its air permitting fee structure to better reflect current program costs and ensure long-term sustainability of the permitting program.

Details

The proposed rule is intended to update the application and processing fees for new and modified facilities seeking a permit and will add an annual fee for existing non-Title V facilities. The fee for non-Title V facilities is new; previously there was no fee charged for these facilities.  The proposed fee revisions are intended to account for inflation and to reduce the air permitting program reliance on the State General Fund for permitting and compliance activities.   Information on the rulemaking can be found at:  https://www.deq.idaho.gov/rules-and-guidance/rulemaking/air-quality-docket-no-58-0101-2602/

The proposed rule was published on September 2, 2026 with comments due on October 2, 2026.
